General Terms and Conditions of Trade

The following terms and conditions apply to all events that take place in the premises of the restaurant HALALI, based in Munich.

  1. Prices and Payment Terms
    a. Our prices are final prices, including the valid VAT and service charge. Rising VAT increases must be passed to the organizer.
    b. In case of long-term orders, we reserve the right to make a recalculation, depending on the market situation.
    c. Invoices are must be paid, without deductions, within 10 days. In case of default we reserve the right to charge default interest of 10% per month, additional to the invoice amount.
    d. The restaurant is entitled to demand a reasonable advance payment or security at any time. The amount of the advance payment and the payment dates can be agreed in text form.
  2. Number of Participants
    a. We expect the estimated number of guests 3 days before the event.
    b. A change of the number of persons as well as the definite number of persons must be reported by the customer no later than 1 day, before the event. Otherwise, the previously mentioned number of persons applies.
    c. Ordered menus will be charged 100%, even if not taken.
  3. Food and Drinks
    a. Drinks are charged according to the list prices of the restaurant. Own food and drinks should not be brought by the organizer and the participants.
    b. In special cases, a written agreement can be made. In these cases, we charge a reasonable service fee or appropriate corkage.
  4. Cancellation
    a. In the case of a short-term cancellation of a previously booked and confirmed event, we reserve the right to charge the costs of provision or the operating profit from the planned deliveries and services.
    b. A free cancellation is possible up to 5 working days before the event. Closed events are unaffected by this. In the case of closed events, a free cancellation is possible up to 10 working days.
  5. Cancellation through the restaurant
    a. The restaurant is entitled at any time to terminate the contract if the event endangers the reputation or security of the house.
    b. In addition, in case of force majeure or if there is another, important reason.
  6. Liability
    a. If the customer is not the organizer at the same time, he is still liable to the restaurant as joint debtor, in addition to the organizer.
    b. The restaurant accepts no liability for any valuables, cash, cloakroom, musical instruments etc. of the participants or the organizer.
  7. Artist Gage
    a. Musician’s and artist’s fees are to be settled by the organizer directly with the persons concerned.
  8.  Jurisdiction
    a. In the event of a legal dispute, the place of jurisdiction is Munich.
  9. Final Determination
    a. Should individual provisions of our terms and conditions be ineffective for certain events, this shall not affect the validity of the remaining provisions. In place of the invalid provisions, a valid provision that comes as close as possible to it applies.
    b. Deviating agreements or subsidiary agreements must be in writing in order to be valid.
